Gearing up for the new RICS Code on Leasing Business Premises

On 11 February, the RICS published its new Code on Leasing Business Premises, which it hopes will improve the process of lease negotiation, making them fairer and more transparent. The Code comes into force on 1 September, giving practitioners six months to familiarise themselves with its detail and to prepare for implementation.

To discuss the practicalities, EG’s Legal & Professional Editor, Sarah Jackman is joined by Warren Gordon – a senior professional support lawyer in the real estate team at CMS and member of the RICS’s working party on the Code.

Gordon discusses the rationale behind it, the detail contained within it, the types of negotiation it applies to and how practitioners ought to be preparing for it.

The UK’s new Silk Road?

With the government setting out a preferred route for East West Rail ahead of further expected announcements in next month’s Budget, ministers have offered welcome, explicit support for the Oxford Cambridge Arc. But will the government’s levelling up agenda see investment diverted to other parts of the country? James Souter and Megan Davies, of Charles Russell Speechlys, join EG's Jess Harrold to discuss the Court of Appeal's decision in the high-profile case Fearn and others v Board of Trustees of Tate Gallery [2020] EWCA Civ 104; [2020] PLSCS 22 - which effectively closes the door on nuisance claims for overlooking.

Souter and Davies take the positions of the Neo Bankside residents and the Tate Modern respectively, addressing the key arguments before the Court of Appeal, explaining the court's findings, and debating whether the correct decision was reached.

In addition, they discuss the potential for the case to go to the Supreme Court.

Law & Borders: Business rates confusion across the UK

Three experts from Colliers - John Webber, Louise Daly and David Hughes - join EG's Jess Harrold to discuss the varying systems of business rates in operation in England & Wales, in Scotland and in Northern Ireland.

They address the difficulties that arise from the cross-border differences, the issues faced by those seeking to challenge their business rates assessments, and how the UK would benefit from a more coherent approach, incorporating the best elements of each system.
